This Privacy Policy (“Policy”) sets out how we collect, use, store, disclose, and safeguard the information of Customers, Candidates, and Visitors who use our website and background verification services (“Services” or “Platform”).
By accessing or using our Services, you acknowledge that you have read, understood, and agreed to the practices described in this Policy. If you do not agree, you may choose not to use our Services.
We understand the sensitivity of the information shared with us, as background verification often involves personal, financial, and professional records. Therefore, we treat data privacy as the highest priority and process all information strictly in line with applicable data protection laws.

2. Applicability

This Policy applies to:
  1. Customers – Organizations, employers, or authorized entities who request and pay for background verification checks through ZKY.
  2. Candidates – Individuals whose background and credentials are being verified at the request of Customers.
  3. Visitors – Any person browsing our website or using our platform without becoming a registered Customer or Candidate.
This Policy governs all interactions you have with ZKY, including signing up, submitting information, undergoing checks, or browsing our website.

3. Information We Collect

To deliver background verification services effectively, ZKY may need to collect different categories of information depending on the type of check requested by the Customer. This information may directly or indirectly identify an individual and is therefore treated as Personal Information.
Based on the nature of the background verification, we may collect the following:
3.1 Personal Identifier Information
  • Full name, date of birth, gender, and contact details (phone number and email address).
  • Current and permanent residential addresses.
  • Government-issued identification such as Aadhaar, PAN, Passport, Voter ID, Driving Licence, etc.
  • For address verification: supporting documents such as ration card, vehicle registration certificates, rental agreements, utility bills, or bank statements that confirm your residence.
3.2 Professional Information
  • Employment details, including names of previous employers, job titles, designations, and departments.
  • Employment history, salary details, benefits, and HR records where applicable.
  • Supporting documentation such as appointment/offer letters, salary slips, experience certificates, and relieving letters.
  • In some cases, if requested by the Customer, we may also carry out professional reference checks by contacting the references shared by the Candidate to validate work experience, skills, and conduct.
3.3 Educational Information
  • Academic details including university/institute name, course, department, and year of graduation.
  • Verification documents such as degree certificates, provisional certificates, consolidated marksheets, transcripts, or other relevant academic records.
3.4 Criminal Background Information
  • Details of pending or past criminal complaints, if any.
  • Verification of court records (civil and criminal) to determine whether the Candidate is associated with ongoing or resolved legal cases.
  • Information sourced from authorized judicial records and public agencies such as the Department of Justice.
  • Where requested by the Customer, ZKY may also conduct global database checks to confirm if the Candidate is associated with organized crimes or is listed in regulatory, compliance, debarment, politically exposed persons (PEP), or financial sanctions databases maintained globally.
3.5 Credit Information
  • Credit history and credit score collected from authorized credit bureaus such as CIBIL.
  • Such checks are carried out using valid identifiers such as PAN to assess the Candidate’s financial credibility.
3.6 Sensitive Personal Information
  • Depending on the type of verification, ZKY may collect data classified as sensitive personal information.
  • If the Customer requests checks requiring access to sensitive data, ZKY will clearly communicate the type of data needed, explain the purpose, and obtain the Candidate’s explicit consent before collection.
  • Sensitive information may include:
    • Medical records or health status (e.g., fitness or drug test reports).
    • Biometric information or other categories as defined under applicable law
3.7 Customer Information
In addition to Candidate data, ZKY also collects certain information from Customers to enable account setup and service delivery:
  1. Signup Information
    • Customer’s name (first and last).
    • Contact details: official email address and telephone number.
    • Login credentials: username, alias, and password (created as per product specifications).
    • Organization details: company/firm name and registered business address.

 2.Billing & Payment Information

    • Payment details including debit/credit card number, billing address, and other related information required to process financial transactions securely.

3. Usage Information

 To improve user experience and ensure smooth functioning of our Platform, ZKY may collect usage-related data, including:

    • Time zone and date/time preferences for product use.
    • IT and system access information such as IP addresses, login details, log files, and encryption keys.
    • Data related to business transactions processed through our platform (e.g., files uploaded for verification, system-generated communications).
    • Metadata, including logs of activity on the system, with identifying details such as: 
      • Creator/author of a transaction.
      • Names of individuals who accessed, uploaded, or downloaded files.
      • Timestamps of access or activity.
      • IP addresses of users accessing the platform.

4. Analytics Information

ZKY may collect information through analytics tools such as Google Analytics and similar technologies to understand how users interact with our Platform. This may include details such as pages visited, time spent on the website, navigation flow, and general usage behavior.
In addition, we may analyze feedback provided by Candidates during the background verification process to improve our service quality and user experience. Certain analytics data may also be automatically collected whenever you visit our website. This data is used only for internal insights, product enhancement, and performance optimization.

Cookies are small text files stored on your computer, mobile device, or browser when you access a website or online platform. They are widely used to make browsing more efficient, store user preferences, and provide reporting information.

    • Remembering returning Customers and their preferences.
    • Improving website performance and navigation experience.
    • Generating statistical reports for analytics and service optimization.

    • Disable cookies completely,
    • Receive alerts before a cookie is stored, or
    • Delete cookies from your system manually.

6.1 Information Provided Directly by You

We collect data directly from Customers and Candidates when they submit it through our Platform, via email, or by providing documents necessary for verification. This includes personal details (e.g., name, email address, phone number) and any supporting records needed to generate a background verification report.

6.2 Information from Third-Party Sources

To fulfill verification requests, ZKY may obtain information from third parties with proper authorization. These sources include:

    • Public Records: Government databases, court records, regulatory watchlists, law enforcement agencies, or other publicly available repositories.
    • Private Records: With appropriate consent, data from educational institutions, past employers, healthcare providers, credit bureaus, and other authorized organizations. 
6.3 Automatically Collected Information

When Customers, Candidates, or Visitors use our website or Platform, certain information is automatically captured. This may include:

    • IP address and geolocation data.
    • Browser type, device information, and operating system.
    • Login activity, session logs, and system usage details.

This data is collected to ensure system security, monitor performance, and enhance user experience. Importantly, automatically collected information is not shared with any third party and is used strictly for improving our Services.

7. Sharing of Personal Information

ZKY shares your Personal Information only with authorized individuals or entities and strictly for the purposes described in this Policy. We do not disclose your information to any third party beyond the categories mentioned below:

    • Employees, Contractors, and Authorized Agents – Personal Information may be accessed by ZKY’s internal teams, contractors, or authorized agents who require it to perform their professional responsibilities. All such individuals are bound by confidentiality obligations and are prohibited from using the information for any purpose other than service delivery.
    • Service Providers and Subcontractors – In certain cases, ZKY may engage trusted vendors or subcontractors to assist in preparing background verification reports. Candidate information is shared with them strictly on a “need-to-know” basis and always in accordance with applicable data protection standards.
    • Customers and Candidates – The final background verification report is shared only with the Customer who requested the verification and the Candidate concerned, except where legal or regulatory requirements dictate otherwise.

    • Regulatory and Legal Authorities – If required by law, court orders, or instructions from law enforcement or investigative agencies, ZKY may share Personal Information with relevant authorities.
    • Litigation and Legal Defense – In the event of a dispute, threatened or actual litigation, or for the protection of ZKY’s legal rights and interests, we may disclose relevant background verification reports to authorized stakeholders.
    • With Explicit Consent – Beyond the scenarios mentioned above, ZKY will never share your Personal Information with any third party unless we have obtained your explicit written consent or you specifically request such disclosure.

8. Purpose of Collecting and Processing Personal Information

We process Personal Information only for legitimate business and service-related purposes. These include:

    • Service Delivery – To conduct background verification checks, generate reports, provide insights, and deliver the functionality of our Platform.
    • Business Operations – To manage Customer accounts, process payments, handle billing, maintain our systems, and resolve errors or discrepancies that may occur during service delivery.
    • Legal and Regulatory Compliance – To comply with applicable laws and regulations, cooperate with law enforcement investigations, protect the legal rights of ZKY, and prevent fraudulent or unauthorized use of our Platform.
    • System Improvement – To conduct audits, quality checks, troubleshooting, and system upgrades that enhance the reliability, performance, and security of our Services.
    • Safety and Security – To prevent duplicate or fraudulent accounts, ensure secure access, protect users against unauthorized activity, and safeguard the overall integrity of our Platform.

9. Your Rights

(a) Right to Rectification – You have the right to request corrections or updates to any inaccurate or incomplete personal information we hold about you. For verification purposes, ZKY may request supporting documents before making any updates to your records.

(b) Right to Withdraw Consent – You may withdraw the consent you have previously provided for the collection and processing of your personal information at any time. Please note that withdrawing consent may prevent us from continuing the background verification process. If you are a Candidate, the consequences of withdrawal on your employment or potential employment are outside ZKY’s responsibility.

(c) Right to Erasure – You may request deletion of your personal information from our systems. Since ZKY processes data on behalf of Customers, such requests will be directed to the Customer (e.g., your prospective or current employer). If we do not receive any response from the Customer within 90 days of your request, ZKY will delete the relevant data from its systems unless retention is necessary for legal or regulatory reasons.

Please note that ZKY cannot delete information stored with third-party institutions (such as universities, employers, or credit bureaus) and you may need to approach them directly.

(d) Right to Access – You can request a copy of the personal information we hold about you. This allows you to confirm whether your information is being lawfully processed and to verify the details stored in our systems.

(e) Right to Restrict Processing – You may ask us to temporarily suspend the processing of your personal information under certain circumstances. However, restricting processing may make it impossible for us to complete the verification process or provide related services.

(f) Right to Data Portability – You have the right to request that ZKY provide your personal information in a structured, machine-readable format or transfer it to another organization where feasible, to object to the processing of your data if it is not aligned with this Policy or applicable laws, and to opt out of receiving any marketing or promotional communications (though essential service updates cannot be opted out of unless you deactivate your account). In cases where sensitive personal information, such as medical or biometric data, is involved, you may ask for clarity on what will be collected and why before giving consent, and you also have the option to provide instructions regarding the handling of your personal information after your death. ZKY does not charge any fees for processing standard rights requests, though a reasonable fee may apply if the request is excessive or repetitive. 10. Children's Privacy

ZKY’s Services are designed for use by adults and are not intended for individuals below the age of 18. We do not knowingly collect or process personal information from anyone under 18 years of age. In exceptional circumstances, if a Customer requires verification of a person below 18, it is the Customer’s responsibility to secure verified parental or guardian consent prior to initiating the process. Under no circumstances may individuals under the age of 13 use our Services.

If we discover that a minor under 18 has shared personal information with us without the required parental or guardian authorization, or if we receive details from a child under 13, we will take prompt steps to delete such information from our systems. If you become aware that a minor has submitted personal information to ZKY, please notify us immediately using the contact details provided in this Policy.

11. Security of Information

ZKY takes the protection of your data very seriously. Your information is stored securely on cloud servers, with our hosting partner adhering to industry-recognized security practices. We have implemented strong technical, physical, and administrative safeguards designed to prevent unauthorized access, disclosure, alteration, or destruction of your data. 11.1 Payment Security
For processing payments, ZKY works with trusted partners such as Razorpay. Our payment partners comply with internationally accepted standards including ISO 27001 and PCI-DSS (Payment Card Industry Data Security Standard), ensuring that your financial information is processed in a safe and secure manner.

12. Updates To This Policy

ZKY reserves the right to modify or update this Privacy Policy at any time to reflect changes in law, technology, or business operations. From time to time, ZKY may send essential service-related communications to Customers and Candidates. These communications may include system updates, maintenance notices, or other important operational announcements necessary for uninterrupted access to our Platform. Such messages are not promotional in nature and cannot be opted out of, except by choosing to deactivate your account.

14. Grievance Redressal

As required under the Information Technology Act, ZKY has appointed a Grievance Officer to address any complaints or concerns regarding your personal information.
